By purchasing, booking, or participating in any tour or activity operated by Cairns Adventure Tours, the customer confirms that they have read, understood, and agreed to the following Terms, Conditions, and Liability Waiver.
Agreement to these terms occurs automatically at the time of purchase or booking, including through the company website, booking platforms, or third-party agents.
Adventure and outdoor activities involve inherent risks that may result in injury, illness, property damage, or death.
These risks may include but are not limited to:
Slips, falls, or physical injuries
Equipment malfunction
Weather changes or extreme environmental conditions
Water hazards or uneven terrain
Wildlife encounters
Remote location risks
Actions of other participants
By purchasing or participating in a Cairns Adventure Tours activity, the customer acknowledges and voluntarily accepts all inherent risks associated with adventure activities.
By completing a booking or purchasing a ticket for any Cairns Adventure Tours service, the customer confirms that they:
Have read and understood these Terms and Conditions
Agree to the Liability Waiver and Risk Acknowledgment
Accept the inherent risks of adventure activities
Agree to follow all safety instructions provided by staff and guides
Completion of a booking constitutes full legal acceptance of these terms without the need for a physical signature.
To the maximum extent permitted by law, Cairns Adventure Tours, including its employees, guides, contractors, and affiliates, shall not be liable for any injury, loss, damage, delay, or death arising from participation in tours or activities.
This limitation applies except where liability cannot legally be excluded under Australian Consumer Law or the Civil Liability Act 2003 (Queensland).
Participants agree that they take part in activities at their own risk.
Participants must:
Follow all instructions provided by guides or staff
Use equipment only as instructed
Inform staff of any relevant medical conditions
Act responsibly and avoid dangerous behaviour
Cairns Adventure Tours reserves the right to refuse or remove participation if a guest:
Poses a safety risk
Is under the influence of alcohol or drugs
Fails to follow safety instructions
No refund may be provided in these situations.
Participants confirm that they are:
Physically and mentally capable of participating in the activity
Free from medical conditions that may create danger during the activity
Customers accept full responsibility for their personal health and safety during the activity.
Participation in tours or activities while under the influence of alcohol or drugs is strictly prohibited.
Cairns Adventure Tours reserves the right to deny participation without refund to anyone suspected of intoxication.
Cancellations made:
More than 48 hours before the tour may receive a full refund or reschedule
Between 24–48 hours before the tour may receive a partial refund
Less than 24 hours before the tour are generally non-refundable
Cairns Adventure Tours may cancel or modify tours due to:
Severe weather
Safety concerns
Operational requirements
Government restrictions
In these cases, customers may be offered:
Rescheduling
Tour credit
A full refund
Safety is the highest priority for Cairns Adventure Tours.
All tours include:
Safety briefings before activities
Trained guides supervising activities
Safety equipment when required
Monitoring of weather and environmental conditions
Participants must comply with all safety instructions at all times.
Failure to follow safety instructions may result in removal from the tour.
During tours, photographs or video recordings may be taken for marketing and promotional purposes.
By participating in a Cairns Adventure Tours activity, customers grant permission for their image or likeness to be used in promotional materials unless they notify the company before the tour begins.

All participants must behave respectfully and safely.

Harassment of staff or other guests
Damage to equipment or property
Ignoring safety instructions
Participants who violate these rules may be removed from the tour without refund.
These Terms and Conditions are governed by the laws of Queensland, Australia, and any disputes shall be handled in the courts of Queensland.
